TERMS, CONDITIONS AND POLICIES FOR CAPE TOWN HELICOPTERS AND THE EXPLORE COLLECTION

Thank you for considering Cape Town Helicopters and the Explore Collection to experience the best of Cape Town and the V&A Waterfront. For us to ensure all our users enjoy the orderly adventure with its safety requirements, we ask that you acquaint yourself with the T’s & C’s pertinent to our offerings.

1. HELICOPTER FLIGHTS

Helicopters are weight-limited and the following guidelines apply:

a. Robinson R44: Maximum weight per seat is 120kg and/ or an average of 90kg's across the three seats, at the pilot's discretion.

b. Airbus H120/ H125 & H130: There is no maximum weight limit per seat, however, an average of 90kg's across each seat applies, at the pilot's discretion.

c. Bell 206 Long Ranger: Maximum weight per seat is 140kg and/ or an average of 75kg's across the three seats, at the pilot's discretion.

d. A surcharge may be levied if a client needs to upgrade to a bigger helicopter due to weight limitations. Prices for the scenic flights are on a per-person basis/a minimum of two (2) passengers sharing. We reserve the right to increase the number of pax on a scenic flight. (Unless an exclusive Flight has been booked by the customer).

Seating is based on the weight and balance of the helicopter.

FLIGHT PREPARATIONS

All flights are to be pre-paid in full. We reserve the right to cancel a flight based on non-payment.

All flights and/ or routes are weather permitting. Flights are based on the route booked and not time.

Cape Town Helicopters/ the Explore Collection will arrange landing permissions and restaurant bookings; however, we are unable to guarantee approval or availability. A minimum 72-hour advance booking is required for all Experiences, Adventure and Wineland flights.

Please note all inclusions and exclusions on the various "Experiences". All exclusions need to be settled directly with any/ all third-party suppliers.

CHILD POLICY

Children 7 years old or younger pay 50% when flying with 2 full-paying adults. Children 8 years old and older are charged as a full paying adult. Eg: Only 1 child with 2 full-paying adults, that is 7 years or younger, will receive a 50% discount on their ticket.
Any additional children 7 years or younger will pay full price. (Discounts not applicable to children 8 years of age, or older, as they pay full adult rates)

For a family of 4 (2 adults and 2 children), only one child of 7 years or younger will receive the discount. The second child will pay the full price.

DEPOSIT/ PAYMENT POLICY

All flights need to be prepaid in full, prior to travel. Kindly send through the Proof of Payment to adventure@helicopterscapetown.co.za.

Groups of 30 pax or more, are required to pay a 50% deposit when booking as confirmation. The balance of payment is due a minimum of 5 days prior to travel.

All Cape Town Helicopter charters/ bookings in excess of R100 000,00, require full payment. If DinePlan reservations were made, this cost will be incurred by the customer. We reserve the right to cancel a flight due to non-payment.

REFUND POLICY

Guests will be eligible for a FULL refund in the event of bad weather, resulting in Cape Town Helicopters/ the Explore Collection cancelling the service and should they not be able to rebook due to pre-existing travel commitments.

CANCELLATION POLICY

50% of the total cost of the flight will be charged for any confirmed booking if cancelled between 7 days and 48 hours prior to the scheduled departure time. The total cost of the booking will be charged if cancelled less than 48 hours before the scheduled departure time.

For all Explore Experiences, should an experience be cancelled within 7 days of travel all refunds will exclude any 3rd party service fees.

2. EXPLORE CRUISES AND PRIVATE CHARTERS

RATES AND PAYMENT

The private charter fee is in South African Rands and includes the use of the yacht, captain, and crew. To reserve the charter, a 50% non-refundable, non-transferable deposit is required. Within 7 working days prior to the charter date, the balance will need to be paid. Should the charter date be less than 7 working days ahead, full payment is required to secure the private charter booking.

Our banking details or a secure payment link will be supplied, at time of making the booking. The charter company may cancel a booking should the charterer fail to make payments as noted above.

CANCELLATION OF CHARTER

If the charter company cancels the trip for whatever reason the charter company will endeavour to re-book the yacht or a full refund will be made. Refunds will be made within 5 working days of the cancellation. If the charterer cancels the trip, half of the full payment is forfeited. If the charterer cancels within 7 days of the charter, no refunds will be paid. For a no-show, there will be no refund!

Please note that changes from the South African government or SAMSA could change the total pax allowed on-board.

Should regulations change at any time due to government announcements, we will reschedule your charter to a future date suitable to you. No refunds will be provided, only rescheduling.

SAFETY

The charter company may terminate the charter, without refund, or recourse from the charterer, or remove one or more persons from the yacht due to actions by the charterer (or their group) which in the opinion of the captain jeopardises the safety of the yacht or persons on board.

CATERING AND BAR REQUIREMENTS

The charterer may supply their own catering. There is a fully stocked bar on-board. Stock is dependent on availability. Own alcohol may be supplied with prior notification to the charter company, however, a R2,000 corkage fee will apply. You can provide your own wine and sparkling wine only for R100 corkage fee per bottle. Please ensure these drinks are kept in your own containers and chilled with your own.

No ciders, spirits, soft drinks, or beers are allowed to be brought on board as they can be bought at our bar.

INSURANCE

The charter company agrees to keep the yacht fully insured against fire, marine risks, collision risks and indemnity coverage for the full term of the charter period. The charterer shall not be liable for any such risk. The charter company shall not be held responsible for loss or damage to personal property, or any injury suffered by the charterer, or any member of its party during the term of this charter, regardless of whether any such loss or injury occurs on board the yacht or elsewhere. More specifically but without limiting the foregoing, the charter company accepts no responsibility or liabilities for accidents, injuries or death related to swimming and or the use of its allied equipment, whether supplied by the charter company or the charterer.

The owners/managers or their agents, the master, officers, and crew of the IQ and Explore catamaran vessel do not accept any liability for loss of life, personal injury, or illness to any person/s or loss of damage to their property whilst on or near the vessel, nor any liability for such happenings as a result of the consumption by such person/s of food and drink. Cape Town Helicopters / Explore Cruises, its owners, employees, agents, and contractors will not be held liable for any loss, theft, or damage to any personal belongings on the property or the vessel, including but not limited to, cash, jewellery, electronic equipment, sporting and recreational equipment.

FORCE MAJEURE

Force majeure is defined as any cause attributed to acts of God, accidents, natural disaster, industrial action, unsuitable weather conditions or other natural occurrences beyond the reasonable control of the charter company not caused by the charter company’s negligence. No warranty is made as to the suitability of weather with respect to the charter. The captain shall have the option of terminating or cancelling the charter any time that he deems necessary.

RIGHT OF ADMISSION

Right of admission is reserved, and all passengers are required to be in possession of a valid boarding ticket before boarding the vessel.

DAMAGES / BREAKAGE CAUSED BY PASSENGERS

Ensure all passengers are respectful of the boat and its contents, any damages caused will be the responsibility of the main booking contact person and they will be held liable for any costs incurred.

ADHERENCE TO DEPARTURE TIMES

Private Charters: Your scheduled departure initiates at the designated time for your excursion. Failure to have you or your team members present and ready for boarding will impact the duration of your cruise. The captain will return at the designated conclusion of your scheduled time to prepare for the subsequent cruise. Please allocate sufficient time for your arrival to ensure you maximize your time on the water.

Scheduled Cruises: The scheduled cruise is set to embark at the specified time. Given the presence of other passengers on board, our vessel will adhere to the departure schedule. Individuals arriving late will forfeit their booking, and no refunds will be granted for no-shows or arrivals after the vessel has set sail.

3. DIGITAL MEDIA

PRIVACY POLICY

This Privacy Policy governs the manner in which Cape Town Helicopters and the Explore Collection collects, uses, maintains and discloses information collected from users (each, a "User") of the Cape Town Helicopters and Explore Collection Website ("Site").

This privacy policy applies to the Site and all products and services offered by Cape Town Helicopters and the Explore Collection.

PERSONAL IDENTIFICATION INFORMATION

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, place an order, subscribe to the newsletter, and in connection with other activities, services, features or resources we make available on our Site.

Users may be asked for, as appropriate, name, email address, mailing address, phone number, and credit card information. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us.

Users can always refuse to supply personal identification information, except that it may prevent them from engaging in certain Site-related activities.

NON-PERSONAL IDENTIFICATION INFORMATION

We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet Service Providers (ISP) utilized and other similar information.

WEB BROWSER COOKIES

Our Site may use "cookies" to enhance User experience. User's web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.

Cape Town Helicopters and the Explore Collection may collect and use Users' personal information for the following purposes:

To process payments:

We may use the information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.

To send periodic emails:

We may use the email address to send User information and updates pertaining to their order. It may also be used to respond to their enquiries, questions, and/or other requests. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.

How we protect your information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.

Sensitive and private data exchange between the Site and its Users happens over an SSL-secured communication channel and is encrypted and protected with digital signatures.

Sharing your personal information

We do not sell, trade, or rent Users' personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.

We may use third-party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes if you have given us your permission.

Changes to this privacy policy

Cape Town Helicopters and the Explore Collection has the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect.

You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Your acceptance of these terms

By using this Site, you signify your acceptance of this policy and terms of service. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
